Terms of Service

1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the Baazar platform, including the website at baazar.com.au, our mobile applications, and all related services (collectively, the “Platform”), operated by Baazar Pty Ltd (ABN: 92 698 446 650) (“Baazar”, “we”, “our”, or “us”).
By creating an account, browsing the Platform, or placing an order, you confirm that you are at least 18 years of age (or have parental consent if younger), have read and understood these Terms, and agree to be legally bound by them.
We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the revised Terms. We will notify registered users of material changes by email.
2. Definitions
- Buyer / Customer: a person who purchases or browses products on the Platform.
- Seller: a business or individual approved by Baazar to list and sell products on the Platform.
- Listing: a product or service offered for sale by a Seller on the Platform.
- Order: a confirmed purchase of one or more Listings by a Customer.
- Platform Fee: the commission or service fee charged by Baazar to Sellers on each completed sale.
- Content: text, images, reviews, data, and other material uploaded to the Platform.
3. Account Registration
To place orders or access certain features, you must register for a Baazar account. You agree to provide accurate, current, and complete information during registration and to keep it up to date.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at hello@baazar.com.au if you suspect unauthorised access.
We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in fraudulent activity.
Email verification: Upon registration, we will send a verification email to the address you provide. You must verify your email before you can complete purchases or access account features.
4. Purchases & Payments
All prices displayed on the Platform are in Australian Dollars (AUD) and inclusive of GST where applicable. Prices are set by individual Sellers and may change without notice.
Baazar uses Stripe as its payment processor. By placing an order, you authorise Baazar to charge the payment method you provide for the total amount displayed at checkout, including product costs, delivery fees, and any applicable taxes.
An order is not confirmed until you receive an order confirmation email. Baazar and/or the relevant Seller reserves the right to cancel or refuse any order — for example if a product becomes unavailable, is mispriced, or if we detect fraud.
Promotions & Promo Codes: Promotional codes are subject to individual terms. They cannot be combined with other offers, exchanged for cash, or applied retrospectively. Baazar reserves the right to withdraw or amend promotions at any time.
5. Delivery & Fulfilment
Delivery is performed by Baazar’s logistics partners and/or approved third-party couriers. Estimated delivery times are indicative only and may vary due to factors outside our control (e.g., weather, high demand periods).
Free delivery thresholds apply on qualifying orders as displayed at checkout. Remote or rural addresses may incur additional delivery charges.
Risk of loss and title for products pass to you upon delivery to the nominated address. If no one is present at delivery, we may leave the order at a safe location or arrange re-delivery; any additional re-delivery fees are your responsibility.
Baazar is not liable for delays caused by incorrect delivery addresses provided by customers.
6. Returns & Refunds
We want you to be satisfied with every purchase. If a product arrives damaged, spoiled, or is materially different from its description, please contact us within 48 hours of delivery with photos and your order number.
Eligible refunds are processed to the original payment method within 5–10 business days. We may offer a replacement, store credit, or full/partial refund at our discretion.
Perishable items (fresh meat, dairy, seafood, produce) are generally not eligible for return once delivered unless they arrive spoiled or incorrect. Please check your order upon receipt.
Change-of-mind returns are not accepted. Australian Consumer Law rights are not affected by these terms.
7. Seller Obligations
Sellers on Baazar must hold a valid Australian Business Number (ABN), comply with all applicable Australian food safety regulations and standards, and maintain any certifications (including halal certification) that they advertise.
Sellers are solely responsible for the accuracy of their Listings, including descriptions, prices, ingredients, allergen information, and images. Baazar is not responsible for errors in Seller-provided content.
Sellers must fulfil orders promptly and in accordance with the advertised specifications. Failure to do so may result in suspension or termination of the Seller account.
Baazar charges a Platform Fee on each completed sale. The applicable rate is communicated to Sellers at the time of onboarding and may be updated with 30 days’ written notice.
8. Prohibited Conduct
You must not:
- Use the Platform for any unlawful purpose or in violation of any regulations.
- Post false, misleading, or fraudulent content including fake reviews.
- Attempt to circumvent our payment systems or otherwise defraud Baazar or other users.
- Harvest, scrape, or data-mine the Platform without our written consent.
- Upload viruses, malware, or any other malicious code.
- Impersonate another person or misrepresent your affiliation with any entity.
- Sell products that are prohibited by Australian law, including illegal substances, counterfeit goods, or unregistered therapeutic goods.
- Engage in any form of spam, unsolicited communications, or abuse toward other users or staff.
9. Intellectual Property
All content on the Platform created by Baazar — including the Baazar name, logo, visual design, software, and text — is owned by or licensed to Baazar and is protected by Australian and international intellectual property laws.
By posting Content (e.g. product reviews, photos) on the Platform, you grant Baazar a non-exclusive, royalty-free, perpetual, worldwide licence to use, reproduce, and display that Content in connection with operating and promoting the Platform.
You warrant that you own or have the right to submit any Content you upload, and that it does not infringe any third-party rights.
10. Limitation of Liability
To the maximum extent permitted by law, Baazar’s liability to you for any loss or damage arising from use of the Platform is limited to the amount you paid for the relevant order.
Baazar is not liable for indirect, incidental, consequential, punitive, or special damages, including loss of profits, data, or goodwill, even if we have been advised of the possibility of such damages.
Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.
11. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your personal information as described in the Privacy Policy.
12. Termination
You may close your account at any time by contacting us. Outstanding orders will still be processed and applicable charges applied.
Baazar may suspend or terminate your access to the Platform immediately, without notice, if you breach these Terms, if we are required to do so by law, or if continued access poses a risk to other users or the integrity of the Platform.
Upon termination, your right to use the Platform ceases. Clauses that by their nature survive termination (including intellectual property, limitation of liability, and dispute resolution) will continue to apply.
13. Governing Law
These Terms are governed by the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales for any dispute arising from or related to these Terms or your use of the Platform.
If any provision of these Terms is held to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force.
